There are still companies that simply invite people to sell products or contracts. “If you receive an unsolicited call with an offer, it is actually not the best offer at all,” says the Dutch Consumer and Markets Authority. Not to mention allowing salespeople to contact you at all.
Veel mensen hebben er een hekel aan als ze uit het niets worden gebeld door verkopers, die bijvoorbeeld een nieuw energiecontract of zonnepanelen willen slijten. De telefoontjes gebeuren ook niet altijd op een fraaie manier. De Autoriteit Consument & Markt (ACM) waarschuwde recent dat het aantal meldingen van agressieve en misleidende werving voor energiecontracten weer toeneemt.
Zo krijgen mensen te horen dat hun huidige leverancier bijna failliet gaat en dat ze snel moeten overstappen, terwijl dat niet zo is. En aanbiedingen van telefonische verkopers zijn meestal niet de beste deals. “Wij adviseren altijd: kijk rustig in je eigen tijd wat er door leveranciers wordt aangeboden en kies dan de beste optie voor jou”, zegt Tjitte Mastenbroek van de ACM.
De toezichthouder deelt geen exacte cijfers over de toename van dit soort telefonische aanbiedingen. “We zien wel dat er klachten binnenkomen”, zegt Mastenbroek. “De meeste gaan over energieleveranciers. Zij waren in de tijd van hoge prijzen in de energiecrisis gestopt met het actief aanbieden van contracten en telefonisch werven. Recent zijn ze weer begonnen, maar wel in mindere mate dan voorheen.”
Businesses are not always allowed to just call
For more than two years, there has been a telemarketing law stating that businesses may not contact consumers unless they give express permission to do so. Businesses must be able to prove that consumers have given this consent.
There is an exception for people who have been a member or client of a company or organization. After termination, these persons may be recalled for another three years.
This often goes wrong. The Consumers Association flagged this a few weeks ago Eight out of ten consumers They are sometimes harassed by telephone salespeople. “Legislation is one thing, but if it is not adhered to properly, it is of no use,” says Sandra Molenaar, director of the Consumers Association. “As far as we are concerned, monitoring and enforcement should be more stringent.”
Report any violation to ACM
If you suddenly receive a sales call, you won’t have time to think through the offer. ACM advises always ending a conversation if there is no interest or doubt.
According to the regulator, sellers should never pressure people to buy something. “Say on the phone ‘I don’t want you to ever call me again’ and hang up immediately,” ACM reported in ConsuWijzer.
If you tell a company that they are no longer allowed to make calls and this still happens, you can report this to ACM. This ensures adherence to the rules. Companies that violate this law risk a fine.
