Dutch tax consultant Frank B. He is accused of conspiring to hide more than 89 million euros from US tax authorities in New York.
“B. thought he was living above the law,” says Thomas Fattorosso, who is working on the case as a special agent for the tax authorities. “This was not a get-rich-quick scheme, but he used some very sophisticated techniques to perpetuate this tax fraud over the years.”
The 63-year-old tax adviser from Norton has been a tax adviser to world-renowned DJs such as Afrojack and Tiesto, as well as various TV presenters and fashion models. According to the prosecutor, his participation in the tax evasion conspiracy spanned more than seven years.
According to the lawsuit, his customers number in the millions every year. In some years, B.’s clients were US taxpayers, meaning they were required by law to pay US taxes on worldwide income. Among these clients, according to the lawsuit, are two internationally renowned DJs who have not been named.
According to the lawsuit, P., along with other business professionals, devised a strategy to illegally hide millions in income from the US government. This income was earned by his clients outside the US while they were US tax residents.
“As a tax advisor to several high-net-worth clients, B. was aware of his clients’ obligation to pay U.S. taxes on their income, but he chose to ignore this obligation and illegally conceal this income from the IRS,” the attorney said.
Advocate: ‘P. Worked in legal framework’
B.’s Dutch lawyer said this week he believes his client “acted within all international tax laws and treaties”. “He worked within the legal framework that the tax treaties gave him. The reason for putting these frameworks in place in the first place was to avoid the risk of double taxation.”
P. was arrested in Italy earlier this year at the request of the United States. A New York prosecutor says he was taken back into custody this week after a positive extradition decision.
